Saturday night August 5rd, 1907, I received
your favor-following:-
Lexington, Ky., Aug. 3, 1907.
"Hon. Robert E. Franklin, Atty at Law,
Frankfort, Kentucky.
Hy dear Sir:—
It was reported
in the afternoon paper of Thursday and
again in the morning paper of yesterday,
that you.had declared that you would
guarantee immunity from arrest to W. S.
Taylor of Indiananolis in the event he

should return to testify on the next trial
of Caleb Powers. I take the liberty of
' ' asking whether this report is true, and
s also whether you are willing to put
this guaranty on your part in such form
as to insure Mr. Taylor freedom from
arrest on the charge against him for
alleged connection with the killing of
Mr. Goebel, in case he should actually
return to Kentucky to testify as suggested.
It seems to me that if it is
seriously proposed to grant the immunity
suggested, to make it absolutely effective,
perhaps the Governor would have to join
with you in the assurance that you give,
though the necessity for this is not en~
tirely clear to me.
I write this letter entirely
on my own motion, and Without any sug—
gestion of any kind from Mr. Powers, or
any one else, and I shall be obliged if
you will favor me with an answer, at
your first convenience.

Touching the above subject matter I would make
the following observations:-
some days since, I did, in substance and effect,

"If William S. Taylor, waiving his right to

decline to answer any question because

his answer might tend to incriminate him

in the conspiracy to murder William Goebel,

would come to Kentucky, appear as a wit—

ness for Caleb Powers and subject himself

unreservedly to an examination and cross—

examination on the Witness stand in the ‘
open court, I would guarantee him immunity -
frOm arrest during his presence in Ken—

tucky for the period of time necessary to

that end.”

I believed then and I believe new that, with
information in my possession, a searching cross—examin—
ation under above waiver by Taylor of his right to de.—
cline to answer, would extract from him such admissions,
or permit the cross—examiner to lay ground so to con—
tradict him as that Taylor's testimony would establish

ness of the Commonwealth's contentions with reference
to the conspiracy that culminated in the murder of
‘ William.Goebel;orrﬁecondwTaylor's absolute unworthiness
of belief. There is so much information, in my opinion,
showing Taylor's own guilty participation in the assassi—
nation of William Goebel(1ruch of which has never yet
been put in proof on any of these trials) that I am
forced to the conclusion here expressed. '

Governor Beckham of Kentucky has made request
of two different successive Governors of Indiana that
William S. Taylor be delivered up to Kentucky, to the
end that he be put upon trial for what is charged as
his part in the murder of William Goebel. Both Indi~
ana Governors refused to accede to Governor Bechham's
request— and so it~is that your client Caleb Powers is
deprived of the legal right he would have, were Taylor
within this jurisdiction, at least to present and
question Taylor as a Witness subject to Taylor’s privi~
lege to decline to answer on the ground that he is him—

 a self under indictment for complicity in the murder of
William Goebel and therefore not to be forced to give
evidence tending to show his own guilt.

If you and your client were to join with me
in presenting to the Governor of Indiana, your clients I
desire that Taylor be present here to testify for him,
do you think it would influence that Governor to honor
Governor Beckhem's requisition for Taylor? Will you
and your client join with me in presenting to the Gov~
ernor of Indiana that desire and will you and your client
join with me in a request of the Governor of Indiana
that he honor Governor Bockhem’s requisition for Taylor?
With Taylor failing and refusing to come as a
Witness, and given refuge and protection by Indiana, as
at present, the only way he may testify is by deposition
taken by interrogatories on motion of your client. But
little can be said in favor of such testimony, because
Taylot may have been well prepared beforehand to give
I in evidence such answers as Powers sight desirclof him,—
a copy of the interrogatories may have beenusent diﬁict

to him at Indianapolis by mail or messengorxb§ Celeb
Powerstith answers enclosed or by the messenger conveyed.
Howeveryes matters standjl cannot see how
Kentucky would suffer by giving Taylor immunity from
arrest for the very short period of time necessary to
be consumed in his coming, testifying and returning to
Indiana. Kentucky and Taylor would thereafter occupy,

they now occupy with reference the one to the other.
Will Taylor come to Kentucky and testify
as and upon the conditions herein suggested?

from the Court of Appeals record of the last trial of Caleb Powers. Vol—
umes 6 and 7 Mr. Goebel did not send, because of his being interested in
an examination of them. The volumes above mentioned I have at the
Wellington Hotel, Georgetown, and will tunn them over to you upon your
calling for them.
