This cause coming on to be heard on the regular call
of the docket at the January term, Floyd County Court,
thereupon came the plaintiff, Commonwealth of kcntucky, by
C. E. Stephens, County Attorney, and announced ready for
trial; thereupon came the defendant, John Coyer, in his
own proper person and by Attorney and announced ready for
trial; thereupon came the following jury, to-witz—
nlbert hurcnett, Clell be Rosette, Joe Salmonds, Sam
Hale, A. J. Snaveley and Sol be Rosette, who were duly em-
panelled, accepted and sworn in the manner provided by low;
thereupon the defendant pleaded "not guilty,“ to the Ver-
rsnt herein; thereupon the Commonwealth introduced as wit~
nesses Lula Viers, Dr. E. H. Archer, Lotta Viers and Lor-
gan Viers, and the defendant herein failed to testify or
to offer any proof herein. Thereupon the court instruct-
ed the jury as follows:- r
"The court instructs the jury that they will find from
the evidence herein for or against the defendant, John Coy~
er, as to whether or not he is the father of the bastard
child, Russell Viers, and if the Jury believe and find from
the evidence that the defendant, John Boyer, is the father
of said bastard child, Russell Viers, then the jury will
further find against the defendant, John Coyer, what sum
he shall pay per your, and for what number of years, for
the keeping, maintenance and education of said bastard
child, Russell Viers-” . .
Thersupon the jury retired and presently returned into ;
court the following verdict:v -*
”We, the jury, agree and find John Coyer is the father 3;
of the bastard child, Russell Viers, and further find the g
